Agency For the purpose of the APA and most other procedural statutes, "agency" is defined to include all Federal government entities in the executive branch, whether or not it is within or subject to review by another agency. It thus includes cabinet departments, "independent regulatory agencies," and administrative agencies that are housed within departments, such as the Occupational Safety and Health Administration (OSHA) within the Department of Labor.
